The fact that he showed inserts that you only get inside the can should have been telling. Not defending him, but it's one reason I would not buy such a thing on eBay

The buyer also didn't realize his bid was being jacked up by a shill with only one transaction. The listing only said "Tin and label show no defects." No where on the auction did it say a sealed tin. Also mentioned above the inserts were shown, clearing saying the tin was not sealed.
I hate seeing people get ripped off, but sometimes you need to have half a brain in your head, which the buyer clearly doesn't.

The inserts are actually just under the plastic lid, so the seal doesn't have to be broken to take them out.

I wonder if this guy will get his money back. Might be tough trying to argue for a tobacco product

That is pretty low, what a scumbag.
That is what I missed about the old ebay, it was easier to spot shill bidders even when their identities were hidden they had the same random number assignment for each bid.
Especially on a McClellands blend, you should be able to see the pull tab unmolested in the gallery....Caveat emptor.
I tried to find where I could look at the sellers history, but was unable to figure how to get to it by using their user name.

Learned a long time ago to look real close at each listing, the seller knew exactly what they were doing and took advantage of the McClelland situation, U+I have personally purchased tobacco on EBay and so far (tough wood), what has delivered is exactly what was sold!
Not many areas to purchase McClelland these days outside of EBay, most people keeping what they have or trading via forums like here and FB Groups!

The winner should just file a not as described. Even if it is something stupid like the colors are not as red as they should be. Boom, refund.

I spoke to a buddy who works for PayPal, she said that if it was purchased through them, you should be able to get a full refund, but you would have to return the product and pay for the shipping costs, open a claim and they will process it!

it's clear to me the seller was clearly out to deceive and capitalise on people's oversight.

Intentional scam or not, there were plenty of signs in that listing to give pause. A buyer does need to at least make a little effort at due diligence.
Or take the chance, pay the price. $160 is pretty cheap as far as life lessons go.

eBay is customer/buyer focused. So, I'm sure this mess can be resolved. Eventually.

If it was not listed as a sealed tin, why would anyone expect it to be? It was a dick move on the seller’s part, but was as described.

Ebay is 100% buyer satisfaction. You can return anything you buy minus shipping cost.

It is my belief that e-Bay doesn't allow the sale of tobacco. I'd not try to buy tobacco there because they prohibit it. Would someone please tell me if I'm wrong. Sorry about your expensive empty tin.

Sorry about your expensive empty tin. I mentioned something similar to this a while back. sablebrush52 replied back that "eBay operates 32 marketplaces worldwide and selling tobacco is not illegal in all of those marketplaces."

" you are buying the highly collectable tin and not the contents within." Although I have seen collectible jars and bags too.

" you are buying the highly collectable tin and not the contents within." Although I have seen collectible jars and bags too. That might give the seller an out, if all sales are final. Ebay makes it clear that tobacco tins aren’t suppose to be sold for their contents even when sealed. I could see where they prohibit sealed tins in the future. There was some talk of them doing that awhile back if I recall.

I think they're just too big to police all their listing (meaning basically too cheap to hire a bunch of people to do it).
And I think they enjoy the 10% they get from every sale + possible other fees, and are happy to just stay quiet about it for the most part.

Here is what eBay says about its no tobacco sales policy - * Any tobacco collectible packaging must be completely empty, with no tobacco inside the package. Tobacco policy overview - You're not allowed to sell tobacco products on eBay, including collectibles that contain tobacco, because of strict government regulations. For details on what can and can't be listed, see our guidelines. Here is the link to the eBay No Tobacco Auctions guidelines - www.ebay.com/help/policies/prohibited-restricted-items/tobacco-policy?id=4273

Asking the seller a couple of questions can save your butt. I would have asked about the contents myself not that I am planning on buying on ebay.

Always the nosy one I had to look and see if this seller was still around. Danged if he doesn't have 100% feedback again. I looked. Guy refunded it and edited it. Used to be that even when you took away the neg it went into limbo, not turning it to pos.
