I think I know the answer but I just wanted to be sure.
Although Ebay says you can't sell tobacco on their site, it is done all day every day and I want to make sure what the deal is. Is it just accepted that it happens and Ebay doesn't care, or is there some magic loop-hole?
I see some listings clearly state that it is pipe tobacco and some say "for collectible purpose only, not for consumption".
I got banned 10 years ago for selling an Opus-X cigar box, I had pictures of the empty box and everything. I have a nightmare of a time with Paypal ever since and I don't want that hassle again.

I’ve sold tobacco a few months ago on eBay. Just write “ sealed and collectors tobacco, not for consumption. I had no issues........Good Luck👍👍

If you get a complaint while the listing is up you can still get suspended / banned. Ebay will gladly take your money unless some other ebayer complains about your listing. I do not know how people go about it without getting a complaint against them but they obviously do because there are hundreds of tins up at any one time. I sold some a few years ago and about half went thru, the other have were taken down. I got a warning that if I did it in the future I would get my account suspended. I never did it again as I did not want the headache.
I had some great discussions with pipestud about ebay on another forum. I wish I knew how they really operate. I swear they manipulate their search engine and show favorites but who knows.

It's expressly forbidden by eBay rules. No way, no how. Not "for collectible value," not because it's 100 years old, none. No tobacco. No leaf, no stem, no ribbon.
It's also expressly forbidden by paypal.
It's also illegal in most states. I want to say more than 40. Selling tobacco without a license is not a fun conversation to have.
So have fun getting banned from eBay, banned from PayPal, and prosecuted by state authorities.
Will any of these happen? not certainly
Can you expect them to happen when you knowingly break the rules and the law? sure.

Mastercard, in addition to PayPal, has their own complex rules about tobacco sales. I am pretty sure buying tobacco illegally on eBay breaks those rules 
The Mastercard rules are why a lot of legitimate online pipe tobacco vendors prefer Visa -- it's just easier on them.

Thanks! I think I will shy away from selling any tobacco related product. ...I've successfully sold a b***load of pipe tobacco through eBay, PayPal and Mastercard... it's all in how one lists it... I got a spanking once from eBay, but only once... I was too descriptive... but they want your $$, so if you list stuff as "collectible tins, sealed" or some such, they won't make a peep. Pipers know what that means... eBay a**holes don't. |

Rules are meant for those not smart enough to bend em. If you want to sell tobacco on flea bay its a unopened collectors tin. Hell you can build a AR15 or 45 off flea bay no gun sales allowed but no problem with parts. Master Card don't give a rats petunia where you use their card as long as they get their cut. In case you have not noticed the store name and the account that gets your credit card funds are almost always different. I suppose me and Martin are the only rebels here.

Ebay appears to be inconsistant with it's posting rules for tobacco products vs. what greases it's coffers. I have only won one auction for Esoterica Tobacciana products approximately 3-4 years ago when the going prices for ET tobacco were more reasonable. Since then I occasionally "watch" some Esoterica listings without actually bidding or using the "buy now" option price when offered. This afternoon I received an email directly from Ebay that read basically like this:
Is Esoterica Tobacciana...still of interest? They offered me a $12.25 off coupon good through June 30 th!!

Absolutely correct. eBay rules are specific, no tobacco of any sort for any reason can be sold on eBay. Collectible tins must be empty of tobacco and listings must include an image of the empty tin. eBay is also an amoral money oriented entity, so while they make a pretense of not allowing the sales of tobacco they also have categories to support the sale of tobacco. However, as a seller you have no rights or recourse if one of your sales goes pear shaped. The money you received will be clawed back and your tobacco will be confiscated and destroyed. Every now and then eBay makes a pretense of enforcing their "rules" and sellers lose their stuff. I suspect it's in response to a complaint lodged with a governmental agency. Then it's "All's Quiet on the Western Front" until the next time eBay has to make some pretense to ward off some punitive action. Sellers are collateral damage in all of this. Just keep this in mind if you decide to sell tobacco on eBay. You never know when a tank will roll over you. |

There's one U.S. ebay seller who offers nothing but tobacco at Buy Now deals.
I haven't used him because tobaccopipes has a better range of baccy at cheaper prices but he did say in an email that he's been selling tobacco on ebay for years.
One German ebay vendor who I've bought several pipes from sold tobacco on a couple of his auctions (I won two tins - Black Forest & Firedance) I've wanted to try Cabbies Mixture & just missed out on 3 tins so I sent an email asking if he sold tobacco at Buy Now prices & he responded with a stern 'I do not sell tobacco'.
I got the vibe that he got a warning for his previous sales.
